Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice (“Notice”) supplements the information in the Sunstone Health Privacy Policy. It applies solely to Nevada and Washington consumers who interact with our service in an individual or household capacity and applies only to personal information defined as “consumer health data” subject to the Nevada Consumer Health Data Privacy Act (applicable to Nevada residents) and the Washington My Health My Data Act (applicable to Washington state residents) (collectively “Consumer Health Data Laws”).
What Does This Notice Cover?
This Notice describes what consumer health data we collect, how we collect and use it, who we disclose it to and why, and the choices you may have regarding our use or disclosure of your consumer health data. This Notice does not apply to any personal information other than consumer health data under Consumer Health Data Laws. Consumer health data does not include publicly available information, protected health information subject to HIPAA, or personal information that has been deidentified. To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.
What Categories of Consumer Health Data Do We Collect?
We may collect or receive the categories of consumer health data listed below. Not all categories will be collected or received for every individual.
- Information received from your claims for health insurance coverage in records held by health care insurance companies.
- Information about your health-related conditions, symptoms, experiences, diagnoses, testing or treatments.
- Health-related surgeries or procedures.
- Use or purchase of prescribed medications.
- Bodily functions, vital signs, symptoms, or measurements.
- Diagnoses or diagnostic testing, treatment, or medication.
- Biometric information.
- Genetic information.
- Other personal information described in our Privacy Policy that is linked to your consumer health data.
What Categories of Sources Do We Collect Consumer Health Data From?
We may obtain consumer health data from different sources which include:
- Directly from patients that interact with our services;
- Health care insurance companies;
- Healthcare providers and care teams;
- Healthcare records management platforms; and
- Other websites and services.
What Are the Purposes for Collecting Your Consumer Health Data?
- To provide you with products and services you request;
- To evaluate new therapies and improve our service;
- To create anonymous, aggregated or de-identified datasets for research and to improve our service; and
- For other purposes with your consent.
What Categories of Consumer Health Data Do We Share?
We may share each of the categories of consumer health data described above. In particular, we may share personal data, including consumer health data, with your consent, to complete transactions or provide products or services you have requested, and for the purposes described herein.
Who Do We Share Your Consumer Health Data With and Why?
We may share consumer health data with the following parties:
- Our affiliates
- Service providers
- Third parties designated by you
- Counterparties and advisors/professionals in corporate transactions
How Can You Exercise Your Consumer Health Data Rights?
If you are a resident of Nevada or Washington, you may have the right to (1) confirm whether we have collected your consumer health data (if you are a resident of Washington state, you also may have the right to request access to your consumer health data); (2) confirm whether we have disclosed or sold your consumer health data; (3) delete your consumer health data; or (4) withdraw your consent or authorization relating to such data. How to Submit an Appeal
You may appeal our decision with respect to a request you have submitted by emailing info@sunstonehealth.com.
Changes to this Notice
The "LAST UPDATED" legend at the top of this Notice indicates when this Notice was last revised. We reserve the right to modify this Notice at any time. We will notify you by updating the “Last Updated” date. Depending on the kind of change we make, we may also notify you directly or ask for your consent to the change. Any modifications to this Notice will be effective upon our posting the modified version or as otherwise indicated at the time of posting.
